1. Definitions

Throughout these Terms, the following definitions apply:

• "Terravane," "we," "us," "our" — the property rental and advisory business operating from Krabi province, Thailand.
• "You," "User," "Client" — any individual who uses our website or engages our services.
• "Services" — the rental listings, home search assistance, and tropical stewardship services offered by Terravane.
• "Site" — this website at terravesoi.club and all associated pages.
• "Agreement" — the legally binding arrangement formed when you engage our services, comprising these terms and any written confirmation exchanged.
• "Property Owner" — the landlord or owner of a rental property listed through or located by Terravane.

2. Acceptance of Terms

By accessing this site, making an enquiry, or proceeding with any of our services, you confirm that:

• You are at least 18 years of age and have the legal capacity to enter into a binding agreement.
• You have read, understood, and accepted these Terms in full.
• You will use our services for lawful, personal purposes only.

If you do not agree to these Terms, please do not use this site or our services.

3. Description of Services

Terravane provides three core services in Krabi province, Thailand:

Service availability is subject to geographic and operational constraints. We reserve the right to modify or discontinue any service with reasonable notice.

4. Enquiries and Confirmations

Submitting an enquiry via our contact form does not constitute a confirmed booking or service agreement. A service engagement is only confirmed when:

• You receive a written confirmation from Terravane by email, and
• Any applicable payment or deposit has been received.

We endeavour to respond to all enquiries within two business days, Monday through Saturday.

5. Pricing and Payment

All prices quoted are in Thai Baht (฿) unless otherwise stated. Current indicative pricing:

• Retreats: from ฿10,000 per week depending on property type and season
• Home Search: ฿17,000 one-time fee, payable on engagement
• Tropical Stewardship: ฿5,000 per month, billed monthly

Prices are subject to change. The price confirmed in writing at the time of engagement is the binding price for that engagement. Payment methods and timing will be specified in your confirmation email. Payments to landlords for rental agreements are made separately and directly to the property owner.

6. Refunds and Cancellations

Cancellation and refund conditions depend on the service:

• Retreats: Cancellations made more than 14 days before the start date will receive a full refund. Within 14 days, the deposit is non-refundable. No-shows are not eligible for refund.
• Home Search: The service fee is non-refundable once the active search process has commenced, defined as the first accompanied viewing or curated shortlist delivered.
• Tropical Stewardship: May be cancelled with 30 days written notice. Fees paid for the current billing month are non-refundable.

Refunds, where applicable, are processed within 10 business days via the original payment method.

7. User Responsibilities

When using this site or engaging our services, you agree to:

• Provide accurate, complete information in all communications with us.
• Not use this site for any unlawful purpose or in any manner that could damage our services or reputation.
• Not attempt to gain unauthorised access to any part of our systems.
• Treat properties and property owners respectfully during any viewings or stays.
• Comply with Thai law and local regulations during any rental stays.
• Notify us promptly of any issues or changes that affect your service engagement.

8. Intellectual Property

All content on this site — including text, imagery, the Terravane name and branding, service descriptions, and methodology documentation — is the intellectual property of Terravane or its licensors. You may not copy, reproduce, distribute, or use any content from this site for commercial purposes without prior written permission. Personal, non-commercial use is permitted.

9. Disclaimers

Terravane provides its services as a facilitation and advisory service. Please note:

• We do not own any of the properties we list or locate on your behalf.
• Rental agreements are between you and the property owner. We provide guidance only.
• Our lease review service does not constitute legal advice. We recommend consulting a Thai legal professional for formal legal guidance.
• While we exercise care in selecting properties, we cannot guarantee specific conditions, views, or amenities beyond what is confirmed in writing.
• Tropical weather conditions may affect property condition or access. Terravane is not liable for force majeure events including monsoon damage, flooding, or natural events beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by Thai law, Terravane's total liability to you in connection with any service shall not exceed the total fees paid to Terravane for that specific service engagement. We are not liable for:

• Indirect, incidental, or consequential losses
• Loss of income, profit, or business opportunity
• Actions or omissions of property owners
• Events outside our reasonable control

11. Privacy

Your use of this site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using this site, you acknowledge that you have read and understood our Privacy Policy.

12. Termination

Either party may terminate a service engagement by providing written notice as specified in Section 6. Terravane reserves the right to immediately terminate any engagement if a client breaches these Terms, behaves unlawfully, or acts in a manner that places our team, property owners, or third parties at risk. Termination does not affect rights or obligations that arose prior to termination.

13. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute:

1. We first ask that you contact us at [email protected] to attempt informal resolution.
2. If informal resolution is not achieved within 30 days, the dispute shall be submitted to mediation in Krabi province.
3. Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Krabi province, Thailand.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of our site or services after changes take effect constitutes your acceptance of the revised Terms. We recommend checking this page periodically.

15. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
• Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
• Entire Agreement: These Terms, together with any written service confirmation, form the entire agreement between you and Terravane regarding our services.
• Assignment: You may not assign your rights or obligations under these Terms without our written consent.
